29 CFR 1915.12(c)(1)(ii): The employer did not ensure that spaces or adjacent spaces that contain or have contained liquids, gases, or solids that were toxic, corrosive or irritant were tested by a competent person to determine the air concentration of toxics, corrosives, or irritants within the space prior to initial entry by an employee. a) At the facility, on tank barge, hull marking Coastal 2526-B: On or about June 28, 2019 and times theretofore, the employer did not ensure a competent person tested the air concentration of toxics including benzene (PEL 1 ppm, STEL 5 ppm) in the space before employees entered cargo tanks with crude oil residue.
