29 CFR 1926.1427(a): The employer did not ensure that each operator was trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section: (a)C & C Construction, Inc. at 82 Burlington Northern Santa Fe Railway, Hazel SD 57242: On or about and at times prior to May 22, 2020, the employer did not ensure that employees operating the Grove TMS 300 crane, Model #8435G, were trained, certified/licensed, and evaluated prior to operating the equipment. This condition exposed employees to struck-by hazards associated with improper crane operation.
