29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment th at were outside acceptable limits (as defined by process information in 29 CFR 1 910.119(d) before further use or in a safe and timely manner: The employer does not correct each deficiency in process equipment (that are outside acceptable li mits) in a safe and timely manner before further use. a) This violation was obse rved on or about December 2, 2010 in the Butadiene Recovery Area, adjacent to th e #2 Pressure Flash Tank, where 20 pound saturated steam was observed to be leaking from the main steam header approximately eight (8) feet above the floor of the first elevation of the unit. Pursuant to 29 CFR 1903.19(d), within 10 cal endar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the ste ps it is taking to assure employees are not exposed to spray by high temperature steam and condensate, escaping from piping in areas where employees walk. b) Th is violation was observed on or about November 15, 2010, facility-wide, when the employer did not address the existing hazards, for employees,associated with oc cupying building structures incapable of withstanding a vapor cloud explosion. T his exposed employees to fire and explosion hazards. Pursuant to 29 CFR 1903.19( d), within 10 calendar days of the date of the citation, the employer must submit documentation showing that it is in compliance with the standard inc luding describing the steps it is taking to ensure that a facility-wide abatemen t plan is in-place to address reducing facility-wide, catastrophic potential to personnel in occupied buildings.
