29 CFR 1910.1025(j)(1)(i) as referenced in 29 CFR 1915.1025: A medical surveillance program was not instituted for all employee(s) who were, or could be exposed to lead above the action level for more that thirty days per year: Location: 100 Military Ocean Terminal Street. Bayonne, New Jersey 07002. a) The employer did not institute a medical surveillance program for employees performing abrasive blasting operations, who were or could be exposed to lead above the action level. On June 26, 2023, An employee performing abrasive sand blasting operations in an empty salt water storage tank was exposed to respirable lead concentrations of 103 micrograms per cubic meter of air, as an 8-Hour Time Weighted Average, exceeding the Permissible Exposure Limit (PEL) of 50 micrograms per cubic meter of air by 2.06 times. Zero exposure was assumed for the unsampled period of 230 minutes. Violation occurred on or around June 26, 2023.
