29 CFR 1910.1026(k)(1)(i)(A): The employer did not make medical surveillance available for all employees who were or could be occupationally exposed to chromium (VI) at or above the action level for 30 or more days a year: a. Rear Yard, Stainless Steel Scrap Burn Area - The employer did not made a medical surveillance program available to an employee was exposed to an airborne concentration of chromium (VI) in excess of the OSHA Permissible exposure limit (PEL) of 0.005 milligrams per cubic meter of air, calculated as an 8-hour time-weighted average (TWA). An employee, conducting the torch burning of stainless steel scrap, was exposed to 8-hour Time Weighted Average (TWA) of 0.019 milligrams per cubic meter of airborne hexavalent chromium during a 436 minutes occupational exposure. The 8-hour TWA employee exposure was 3.8 times respectively the OSHA Permissible Exposure Limit (PEL) of 0.005 milligrams per cubic meter. The violation was noted on March 7, 2019.
