29 CFR 1910.1025(g)(1)(ii) as referenced in 29 CFR 1915.1025: Appropriate protective work clothing and equipment was not provided when employee(s) were exposed to lead above the permissible exposure limit (PEL), without regard to the use of respirators, or where the possibility of skin or eye irritation exists, such as shoes or disposable shoe coverlets: Location: 100 Military Ocean Terminal Street. Bayonne, New Jersey 07002. a) The employer did not provide employees with appropriate protective work clothing, such as disposable shoe coverlets. On June 26, 2023 an employee performing abrasive sand blasting operations in a salt water storage tank was exposed to inorganic arsenic at concentrations of 35 micrograms per cubic meter of air, as an 8-Hour Time Weighted Average, exceeding the Permissible Exposure Limit (PEL) of 10 micrograms per cubic meter of air by 3.5 times. Zero exposure was assumed for the unsampled period of 230 minutes. Violation occurred on or around June 26, 2023.
