Labor and Employment Article, Section 5-104(a): The employer did not furnish emp loyment and a place of employment which were free from recognized hazards that w ere causing or likely to cause death or serious physical harm to employees: (a)D ate of Violation:On or About 06/08/11 Location:Manhole 13-4, South Embankment Eq uipment:Kobelco Excavator, Model # 235SR Condition:An employee operating an exca vator did not utilize its equipped seatbelt. One reasonable and feasible means o f abatement method to correct this hazard would be to utilize the equipped restr aint system. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
