29 CFR 119(m)(1) The employer did not investigate each incident which resulted in, or could reasonably have resulted in a catastrophic release of highly hazard ous chemical in the workplace. The employer does not ensure that all incidents a re investigated. This violation was observed on or about May 7, 2010. The employ er failed to investigate a) an incident that occurred in mid- December, when the expansion joints were blown out on the Belco, and b) an incident that occurred on 02/03/2010 that tripped the SRU. Malfunctioning valves were involved in both incidents, and were also involved in the 02/05/2010 incident that destroyed the Belco Unit. This condition exposes employees to fire and explosion hazards. Purs uant to 29 C. F. R. 1903.19, within ten (10) calendar days of the date of this c itation, the employer must submit documentation that it is in compliance with th e standard, including reporting all incidents which resulted in, or could reason ably have resulted in a catastrophic release of highly hazardous chemicals in the workplace.
