Text For Citation: 01 Item/Group: 012 Hazard: REFINERY
29 CFR 1910.119(m)(3): The employer did not involve a contract employee on the i ncident investigation team when the incident involved the work of the contractor . This violation was observed on or about 1/19/2010, the employer did not includ e at least one contract employee on the investigation team that was charged with investigating the fire and explosion on the EC2 platform on 1/13/2010. Employees of the contra ctor, Island Operating Inc, were subject of the investigation but were not inclu ded as member(s) of the investigation. This exposed employees to fire, explosion and highly hazardous chemicals (HHC) in the future due to their input/expertise being considered. Pursuant to 29 CFR 1903.19(d), within 10 calendar days of the date of the citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps it is taking to ensure that, when contract employees are involved, the contractor must be inclu ded on the investigation team.
