Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to : (a) Facility; On or about August 22, 2002, annual, monthly and daily inspections had not been conducted on the two one and one half ton Jet hoists. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop a preventative maintenance program which incorporates all recommendations outlined in the manufacturer's manuals with written, signed and dated reports and also in accordance with ANSI B30.11 in order to ensure a safe and properly functioning hoist.
