29 CFR 1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Warehouse Area - On or about 12/11/2020, the employer exposed employees throughout the facility to struck-by hazards in that uncertified employees were allowed to operate the company's powered industrial trucks including, but not limited to, eight (8) electric sit-down fork trucks, including Crown Model #: FC 4000 S/N: Unknown; four (4) sit-down fork trucks with poles including, Clark Model #: ECX 32, S/N: ECX360-0604-9653; an unknown number of electric pallet jacks including Crown Model #: PE3540-80, S/N: 6A153900; thirty-five (35) electric stock pickers including Crown Model #: SP3520-30, S/N 1A379919; two (2) reach trucks.
