29 CFR 1910.146(d)(4)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not provide, at no cost to the employees, testing and monitoring equipment needed to comply with 29 CFR 1910.146(d)(5), maintain that equipment properly and ensure that employees used the equipment properly: a) On or about November 29, 2012, Phoenix Industrial Cleaning, Inc. did not provide, maintain and ensure the use of testing and monitoring equipment to employee(s) to evaluate the permit space conditions prior to entry into a 6,000 gallon 16 foot vertical chemical storage tank at Sunnyside Corporation in Wheeling, Illinois. This tank was last used by Sunnyside Corporation to store methylene chloride.
