29 CFR 1926.1412(f)(1): The equipment was not inspected at least every 12 months by a qualified person in accordance with paragraph (d) of this section: (a)C & C Construction, Inc. at 82 Burlington Northern Santa Fe Railway, Hazel SD 57242: On or about and at times prior to May 22, 2020, the employer did not ensure that the Grove TMS 300 Crane, Model #8435G being used to offload material and remove grain bin equipment was inspected at least every 12 months by a qualified person. The crane was leaking hydraulic fluid. This condition exposed employees to the hazard of improper crane operation.
