29 CFR 1910.119(h)(2)(i): The employer, when selecting a contractor, did not obtain and evaluate information regarding the contract employer's safety performance and programs: ALON USA, LP, 200 Refinery Road, Big Spring, TX. The employer does not perform their obligations to obtain and evaluate the contractors' safety and health programs. This violation was observed on or about April 15, 2009 in the following instance: Contractors entered vessels that should have been considered Permit Required Confined Spaces (PRCS) in the Alky Unit depropanizer to construct scaffolding without appropriate evaluation and documentation of the PRCS. These contractors include, but are not limited to: Conex Internationals; Bay Ltd; IPR EMS; Nola B; Northwest Insulation; Tessco; Universal Contractors and Vanco. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to obtain and evaluate information regarding the contract employer's safety performance and programs.
