29 CFR 1910.134(h)(4)(i): Repairs or adjustments to respirators were not made using the respirator manufacturer's NIOSH-approved parts designed for that respirator: (Construction Reference 1926.103) (a) On or about 08/28/2024 at the MTA-F line a 2.10-mile-long elevated steel structure from Kings Highway above McDonald Ave/Shell Road/West 6th Street and West 8th Street. A Vacuum Operator was permitted to wear a 3M half face respirator with organic cartridges with a P-100 particulate cartridge duct taped to the cartridge exterior. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
