29 CFR 1926.1101(i)(1): The employer did not provide or require the use of protective clothing such as coveralls or similar whole-body clothing, head coverings, gloves, and foot coverings for employees performing Class I work which involved the removal of over 25 linear or 10 square feet of thermal system insulation or surfacing asbestos containing material and presumed asbestos containing material: a) On or about November 16, 2023, K.L.F. Enterprises, Inc. conducted structural demolition work using an excavator at 2615 Washington St., Waukegan, IL 60085 and removed fireproofing insulation sprayed on structural beams, which contained 15% chrysotile asbestos. The employer did not provide or require the use of protective clothing such as coveralls, or similar whole-body clothing, head coverings, gloves, and foot coverings, for employees performing Class I asbestos work. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
