29 CFR 1910.1025(e)(3)(i) as referenced in 29 CFR 1915.1025: The employer did not establish and implement a written compliance program to reduce exposures to or below the permissible exposure limit, solely by means of engineering and work practice controls: Location: 100 Military Ocean Terminal Street. Bayonne, New Jersey 07002. a) The employer did not establish and implement a written compliance program to reduce employees exposure to lead below the permissible exposure limit. On June 26, 2023, An employee performing abrasive sand blasting operations in an empty salt water storage tank was exposed to respirable lead concentrations of 103 micrograms per cubic meter of air, as an 8-Hour Time Weighted Average, exceeding the Permissible Exposure Limit (PEL) of 50 micrograms per cubic meter of air by 2.06 times. Zero exposure was assumed for the unsampled period of 230 minutes. Violation occurred on or around June 26, 2023.
