Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling loads: (a) Facility, Spruce Street, Windber, PA: On or about April 8, 2009, employees are exposed to falling loads while reaching under the truck bed to put the pin in the hoist while the truck bed is being suspended by the hoist. (b) Facility, Spruce Street, Windber, PA: On or about April 8, 2009, frequent (monthly) hoist inspections are not being conducted. In addition, the periodic (yearly) hoist inspections are not being conducted in accordance with the hoist manufacturer's recommendations. Among other methods, one feasible and acceptable means of abatement for item (a) is to develop a method to insert the pin whereby the employee does not have to put any part of his body between the truck frame and the suspended load (bed). Among other methods, one feasible and acceptable means of abatement for item (b) is to conduct monthly and yearly inspections in accordance with the manufacturer's recommendations.
