29 CFR 1910.119(e)(3)(v): The process hazard analysis did not address facility siting: a- Hess Port Reading Refinery - The employer failed to complete their 2007 Facility Siting Study and respective PHA for the refinery. Condition noted on or about 02/27/09. Abatement Note The 2002 refinery facility siting survey and PHA along with updates/revalidations performed in 2005 and 2007 used API 752, Section 2.5.2 occupancy criteria evaluations as the basis for determining that adequate protection was provided for employees in occupied structures which the employer identified as being potentially subject to explosions, fires, ingress of toxic materials or high energy releases. OSHA does not accept such occupancy criteria evaluations as a basis for determining risk.
