Text For Citation: 01 Item/Group: 010 Hazard: CHEMICAL
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to chemical and laceration hazards: (a)Pinneo Feedlot, Ltd. Liability Company at 32295 Highway 34, Brush, CO 80723: On or before 09/19/06, the employer did not conduct a hazard assessment of the workplace, including both the maintenance shop and the mill, to determine if hazards are present, or ar likely to be present, which necessitates the use of personal protective equipment. Where personal protective equipment was necessitated, the employer did not; 1)Select, and have each affected employee use, the types of PPE that will protect the employee from the hazards identified in the hazard assessment; 2)Communicate selection decisions to each affected employee; 3)Select PPE that properly fits each affected employee. Employees were exposed to chemical hazards when working with solvents, antifreeze, oil, and other chemicals without the use of splash resistant glasses, and without the use of chemical resistant gloves. Employees working with sharp objects, and also exposed to grain dust in and around the mill. This is applicable to both sites. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter") Abatement Note: Among other methods, one feasible and acceptable abatement method is to follow manufacturers directions and material safety data sheets in providing and requiring the use of appropriate personal protective equipment. Also point of reference is 1910.132(d). A hazard assessment consists of identifying the tasks, the hazards associated with the tasks, and finally, the necessary personal protective equipment. This hazard assessment should be posted on the employee bulletin board to serve as a means of communicating expectations related to required PPE.
