29 CFR 1910.1025(d)(2) as referenced in 1915.1025: An initial determination was not made to determine if any employee may be exposed to lead at or above the action level: Location: 100 Military Ocean Terminal Street. Bayonne, New Jersey 07002. a) The employer did not make an initial determinate that employees sand blasting in the salt water tanks were not exposed to lead at or above the action level. On June 26, 2023, An employee performing abrasive sand blasting operations in a salt water storage tank was exposed to respirable lead concentrations of 103 micrograms per cubic meter of air, as an 8-Hour Time Weighted Average, exceeding the Permissible Exposure Limit (PEL) of 50 micrograms per cubic meter of air by 2.06 times. Zero exposure was assumed for the unsampled period of 230 minutes. Violation occurred on or around June 26, 2023.
