29 CFR 1910.242(a): General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees: a) On or about February 14, 2023, at a workplace located at 210 Maple Street, Denmark, Wisconsin, in the Gift Packaging Department; employees working at the 10 staple gun stations utilizing pneumatic Omer staple guns that were mounted upside down on a bracket with the trigger safeties defeated with zip ties were exposed to potential impalement hazards. b) On or about February 15, 2023, at a workplace located at 210 Maple Street, Denmark, Wisconsin in the Cheese Box Area; employee working at the six staple gun stations utilizing pneumatic Omer staple guns that were mounted upside down on a bracket with the trigger safeties defeated with zip ties were exposed to potential impalement hazards.
