29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv): (a) On or about October 27, 2016, the employer did not ensure that employees were adequately trained on the hazards of chemicals being used, stored, and processed, the availability and location of safety date sheets, information relative to the protective actions, and protective equipment required to prevent exposure and injury at the Cornell St. location. (b) On or above October 27, 2016, 250-gallon totes which contained various chemical residual's were processed through a "cut-and-scrape operation wherein the tote was cut to allow access to the residual, and the residual was then scraped from the tote. The scraped residuals were combined in a communal collection bin, resulting in comingled chemicals. The potential mixing of reactive materials/chemicals in the cut-and-scrape process, exposed employees to reactive chemical hazards (such as, but not limited to, chemical burns, burns from flame, inhalation of toxic gases/vapors, struck-by-container fragments, etc.) associated with unwanted byproducts of potential chemical reactions including the generation of heat, the generation of gases/vapors with hazardous properties, and the generation of pressure.
