29 CFR 1910.1000(e):Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): Standard Technologies, LLC located at 2641 Hayes Avenue in Fremont, Ohio 43420: On or about March 10, 2022 the employer did not implement adequate engineering or administration controls to reduce employees' exposures to particulates not otherwise regulated (total dust & respirable) and carbon black. Employees were exposed to hazards associated with elevated exposures to particulates not otherwise regulated and carbon black such as, but not limited to, irritation to the eyes, skin, throat, and upper respiratory system, decreased pulmonary function and myocardial dystrophy. Instance A On March 10, 2022 the employer did not implement adequate engineering or administration controls to reduce employees' exposures to particulates not otherwise regulated (total dust). An employee engaged in electrostatic powder coating was exposed to an 8-hour time weighted average (TWA) of 227.06 mg/m3 for particulates not otherwise regulated (total dust), approximately 15 times the Permissible Exposure Limit (PEL) of 15 mg/m3. The exposure level was derived from a sample collected over a 472-minute sampling period, with zero exposure assumed for the unsampled period of 8 minutes. Instance B On March 10, 2022 the employer did not implement adequate engineering or administration controls to reduce employees' exposures to particulates not otherwise regulated (total dust). An employee engaged in electrostatic powder coating was exposed to an 8-hour time weighted average (TWA) of 478.43 mg/m3 for particulates not otherwise regulated (total dust), approximately 31 times the Permissible Exposure Limit (PEL) of 15 mg/m3. The exposure level was derived from a sample collected over a 425-minute sampling period, with zero exposure assumed for the unsampled period of 55 minutes. Instance C On March 10, 2022 the employer did not implement adequate engineering or administration controls to reduce employees' exposures to particulates not otherwise regulated (respirable). An employee engaged in electrostatic powder coating was exposed to an 8-hour time weighted average (TWA) of 12.3 mg/m3 for particulates not otherwise regulated (respirable dust), approximately 2.5 times the Permissible Exposure Limit (PEL) of 5 mg/m3. The exposure level was derived from a sample collected over a 430-minute sampling period, with zero exposure assumed for the unsampled period of 50 minutes. Instance D On March 10, 2022 the employer did not implement adequate engineering or administration controls to reduce employees' exposures to carbon black. An employee engaged in electrostatic powder coating was exposed to an 8-hour time weighted average (TWA) of 9.9 mg/m3 for carbon black, approximately 2.8 times the Permissible Exposure Limit (PEL) of 3.5 mg/m3. The exposure level was derived from a sample collected over a 472-minute sampling period, with zero exposure assumed for the unsampled period of 8 minutes. Instance E On March 10, 2022 the employer did not implement adequate engineering or administration controls to reduce employees' exposures to carbon black. An employee engaged in electrostatic powder coating was exposed to an 8-hour time weighted average (TWA) of 34.4 mg/m3 for carbon black, approximately 9.8 times the Permissible Exposure Limit (PEL) of 3.5 mg/m3. The exposure level was derived from a sample collected over a 425-minute sampling period, with zero exposure assumed for the unsampled period of 55 minutes.
