29 CFR 1910.119(o)(4): The employer did not determine and document an appropriate response to each of the findings of the compliance audit required by 29 CFR 1910.119(o)(1), and document that the deficiencies had been corrected: a) Formosa Plastics Corporation, USA, Delaware City, DE - Appropriate responses were not provided by the employer for the deficiencies identified during the onsite process safety management audit conducted on July 6th and 7th, 2011. Appropriate responses were not provided for deficiencies such as, but not limited to, the following: 1. The basis for setting limits for safe operating limits was not available; 2. Employees indicated challenges in training on emergency situations and requested more training on emergency / upset conditions; 3. Information on contractor questionnaires reviewed during the audit was found to be inconsistent; 4. Little to no documentation was available on the periodic inspections of contractors in regulated process areas; 5. Many required PMs were shown as overdue on the PM Work Order Abnormality Report; 6. Emergency response and incident command training is not conducted based on the plan to utilize the DC-CAER group for emergency support. However, shift supervisors are expected to "stop and contain" spills. ABATEMENT DOCUMENTATION REQUIRED.TION
