29 CFR 1910.212(a)(1): The employer did not ensure one or more methods of machine guarding was provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, in-going nip points, rotating parts, flying chips and sparks: (a)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to December 13, 2023, the employer did not ensure employees were protected from laceration and amputation hazards by the use of appropriate guarding methods on the Schlebach-Slasher Model # MSS 1250, Serial # 99110040. The automated metal slasher/slitter machine used to cut aluminum was located adjacent to the lamination area had the manufacturer provided fixed guard resting on top of the machine. This condition exposed employees to laceration and amputation hazards. (b)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to December 13, 2023, the employer did not ensure employees were protected from caught-in hazards in that the Wissota bench grinder was not provided with safety guards which covered the wire wheel brush and spindle end and nut flange projections. This condition exposed the employee to caught-in hazards.
