29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) Worksite North side 101 Searing Avenue Mineola NY. On or about May 8th, 2023 Employees were working in an excavation approximately 6ft - 10 ft. deep. The excavation had vertical walls and the employees were not protected from cave-ins by an adequate protective system. b) Worksite South side 101 Searing Avenue Mineola NY. On or about May 8th , 2023 Employees were installing concrete forms in an excavation approximately 10 feet deep. The excavation had vertical walls and the employees were not protected from cave-ins by and adequate protective system. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
