29 CFR 1926.1101(k)(9)(i): The employer did not ensure participation in the asbestos training program by each employee who was likely to be exposed to asbestos in excess of the permissible exposure limit (PEL), or for each employee engaged in Class I through Class IV asbestos operations: a.) Facility - On or about 5/14/16, two employees removed an ~ 15' x 7' foot section of wooden flooring that contained a layer of ACM insulation materials (25% chrysoltile) between the layers of wood. The employer did not ensure that the employees removing the materials and who were likely to be exposed to asbestos in excess of the permissible exposure limit (PEL) or for each employee engaged in Class I through Class IV asbestos operations, had participated in the required asbestos training program. NO ABATEMENT CERTIFICATION REQUIRED
