29 CFR 1910.1053(j)(1):The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200): a.) On or about November 16, 2023, and at times prior, the employer did not establish a hazard communication program which included respirable crystalline silica. OSHA conducted personal exposure sampling on November 29, 2023 and found three employees exposed to 8-hour Time-Weighted Averages over the Action Level of 25 micrograms per cubic meter and the OSHA Permissible Exposure Limit for respirable silica.
