29 CFR 1910.1053(j)(1):The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200): On or about February 8, 2022, the employer failed to ensure that each employee exposed to respirable crystalline silica had access to safety data sheets and was trained on the health hazards associated with exposure to respirable crystalline silica, the specific tasks in the workplace that could result in exposure to respirable crystalline silica, specific measures that have been implemented to protect employees, and the purpose of the the medical surveillance program. The employer did not ensure that employees working at the 80T-1 Press were not exposed to levels of respirable silica at or above the action level. An employee working primarily on press 80T-1, was exposed to 31.62 mg/m3 of respirable crystalline silica over a sampling period of 428 minutes, approximately 1.26 times the action limit. Exposure calculations included a zero increment for the time not sampled.
