29 CFR 1926.552(b)(1)(ii): Employees shall not be allowed to ride on material hoists for purposes other than inspection and maintenance: (a)C & C Construction, Inc. at 82 Burlington Northern Santa Fe Railway, Hazel SD 57242: On or about and at times prior to May 22, 2020, an employee utilized a material hoist to lift another employee to conduct welding activities. On May 22, 2020, an employee was lifted into position in a 55-gallon drum elevated by a material hoist in order to perform welding activities on a tower section. The system failed resulting in the employee falling approximately 40 feet. This condition exposed an employee to a fall hazard of approximately 40 feet.
