OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees At the time of the inspection employees are working on machines and equipment that have the potential to expose employees to the unexpected energization or start-up of the machines or equipment, and/or the release of stored energy which could cause serious injury or death. The employees had not locked out the electrical on overhead door controls in the maintenance shop prior to maintenance activities. Abatement: One method of abatement to correct this apparent hazard is to lock out the electrical in the breaker box prior to conducting maintenance. DISCLAIMER: a/ The employer is not limited to the abatement method suggested by OSHA. b/ The employer is responsible for selecting and implementing an effective abatement method. IN THE ALTERNATIVE: 29 CFR 1910.147(a)(3)(i): This section requires employers to establish a program and utilize procedures for affixing appropriate lockout devices or tagout devices to energy isolating devices, and to otherwise disable machines or equipment to prevent unexpected energization, start up or release of stored energy in order to prevent injury to employees. At the time of the inspection employees are working on machines and equipment that have the potential to expose employees to the unexpected energization or start-up of the machines or equipment, and/or the release of stored energy which could cause serious injury or death. The employees had not locked out the electrical on overhead door controls in the maintenance shop prior to maintenance activities. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.
