Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about March 18, 2004 at the establishment located at 701 Space Center Drive in West Memphis Arkansas employees operating forklift trucks were not required to wear seat belts when provided. Abatement Note: One feasible and acceptable abatement method to correct this hazard is to require and effectively enforce the use of operator restraint systems (seat belts) while operating forklift trucks provided with them.
