29 CFR 1910.165(b)(1): The employee alarm system did not provide warning for necessary emergency action as called for in the emergency action plan, or for reaction time for safe escape of employees from the workplace or the immediate work area, or both: (a) Ring-neck Energy & Feed, LLC dba Ringneck Energy LLC at 901 Redwood Avenue in Onida, SD 57564: On or about and at times prior to July 9, 2023, the employer did not ensure the employee alarm system provided employees warning of the accumulation of flammable vapors in the operations building to provide for necessary emergency action or reaction time to allow for a safe escape. Note: 29 CFR 1910.165 is required by 29 CFR 1910.38(d), which is required for process safety management-covered processes by 29 CFR 1910.119(n)
