29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): On or about November 3, 2022, effective engineering control measures were not implemented where an employee cleaning aggregate buildup from mixer blades and sides was exposed to respirable dust levels of 83.22 mg/m3 for an 8-hour day, which is approximately 17 times the permissible exposure limit of 5 mg/m3. Sampling was conducted for a period of 439 minutes, with zero exposure assumed for the remaining 41 minutes.
