29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace: On or about August 17, 2021, Oberweis Dairy, Inc. did not ensure an Oberweis employee was medically evaluated prior to an emergency response investigation on or near Evaporator 14 valve station. The employee was allowed to wear a full-face tight-fitting respirator while being exposed to an inhalation hazard caused by the ammonia release. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
