29 CFR 1910.1053(i)(1)(i): The employer did not make medical surveillance available at no cost to each employee, and at a reasonable time and place, for each employee who has been occupationally exposed to respirable crystalline silica at or above the action level for 30 or more days per year: a.) On or about November 29, 2023, and at times prior, employees were exposed to respirable crystalline silica above the OSHA PEL and the Action Level during brick cutting operations. The employer did not provide medical evaluations for employees who may reasonably be expected to be exposed to respirable crystalline silica at or above 25 ug/m3 and 50 ug/m3. OSHA conducted exposure assessments on November 29, 2023 and found three employees sampled in the saw room (brick cutting) were exposed to an 8-hour Time-Weighted Average of 349.3, 373.4, and 329.7 micrograms per cubic meter of respirable crystalline silica, above the Action Level of 25 micrograms per cubic meter and the OSHA PEL of 50 ug/m3. The brick cutting tasks have been occurring at this facility for 8-hour shifts for three times a week or more for over 10 years.
