29 CFR 1910.1018(p)(1)(iii) as referenced in 29 CFR 1915.1018: The employer did not include inorganic arsenic in the hazard communication program established to comply with the HCS (�1910.1200). The employer shall ensure that each employee has access to labels on containers of inorganic arsenic and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (o) of this section: Location: 100 Military Ocean Terminal Street. Bayonne, New Jersey 07002. a) The employer did not include inorganic arsenic in the hazard communication program. On June 26, 2023 an employee performing abrasive sand blasting operations in a salt water storage tank was exposed to inorganic arsenic at concentrations of 35 micrograms per cubic meter of air, as an 8-Hour Time Weighted Average, exceeding the Permissible Exposure Limit (PEL) of 10 micrograms per cubic meter of air by 3.5 times. Zero exposure was assumed for the unsampled period of 230 minutes. Violation occurred on or around June 26, 2023.
