29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators; or where manufacturer's specifications are not available, the limitations assigned to the equipment were not based on the determinations of a professional engineer competent in the field: (a)C & C Construction, Inc. at 82 Burlington Northern Santa Fe Railway, Hazel SD 57242: On or about and at times prior to May 22, 2020, the employer did not ensure that the material hoist system consisting of a Sasgen Derrick Co. winch and Predator 670 cc V-Twin Horizontal Engine were used according to the manufacturer's specifications and limitations. The employer did not have manufacturer's data available nor had the system been evaluated by a professional engineer. This condition exposed employees to fall, struck-by and crushing hazards associated with overloading the material hoisting system.
