29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe have not been taken out of service until restored to safe operating condition: Location: Work Floor The violations was observed on November 28th, 2016, when an employee was operating a forklift whose emergency brake was inoperable. To abate this violation, the employer must ensure that all forklifts found to be in need of repair, defective, or unsafe, are taken out of service. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance
