Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees. Confined spaces which could be inadvertently entered did not have signs identifying them as confined spaces. New Sludge Building. There were no signs to warn employees of confined space hazards. Feasible abatements methods would include compliance with the American National Standards Institute Z117.1-1989 Standard for Confined Space Entry and the posting of signs to identifying it as a confined space that requires an entry permit before entry.
