29 CFR 1926.1101(k)(9)(i): The employer did not ensure participation in the asbestos training program by each employee who was likely to be exposed to asbestos in excess of the permissible exposure limit (PEL), or for each employee engaged in Class I through Class IV asbestos operations: a) Kenmore West High School, 33 Highland Parkway, Buffalo, NY, rooms 321, 322, 323, 324, 325, 326, 327, 327A, 327B, 328, and 329 - On or about June 28, 2022 through July 1, 2022 and July 5, 2022 - the employer did not ensure participation in the asbestos training program by each employee who was likely to be exposed to asbestos in excess of the permissible exposure limit (PEL), or for each employee engaged in Class II asbestos work activity of drilling into ceilings containing asbestos containing material (ACM) and/or presumed asbestos containing material (PACM). NO ABATEMENT CERTIFICATION REQUIRED
