29 CFR 1910.119(n): The employer did not establish an emergency plan for the entire plant in accordance with the provisions of 29 CFR 1910.38: a) Chlorine Storage Building: The employer failed to develop and implement written procedures for handling small chlorine releases. Employees were required to respond to any chlorine releases of less than 10 pounds, on or about 1/21/2021. b) Chlorine Storage Building: The employer failed to develope and implement written procedures for emergency evacuation, including type of evacuation and exit route assignments for employees who would investigate a possible leak when sensors alarmed and address the leak if the leak contained less than 10 pounds of chlorine, on or about 1/21/2021. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
