29 CFR 1926.651(k)(1): The employer did not ensure that daily inspections of excavations, the adjacent areas, and protective systems were be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections were also not made after every rainstorm or other hazard increasing occurrence. On or about April 13, 2020, and times prior to, the employer did not conduct inspections when employees were working in an unprotected excavation at a depth of 15 feet, exposing employees to engulfment and struck by hazards.
