29 CFR 1910.119(n): The employer did not establish an emergency plan for the entire plant in accordance with the provisions of 29 CFR 1910.38, and including procedures for handling small and/or incidental releases: (a) Location - 9 Opportunity Way, Newburyport, MA: On or about December 4, 2018, the name or job title of every employee who may be contacted by employees who need more information about the plan or an explanation of their duties under the plan was not included in the facility's integrated contingency plan. (b) Location - 9 Opportunity Way, Newburyport, MA: On or about December 4, 2018, the facility's integrated contingency plan did not include information describing the employee alarm system and the methods and means undertaken to ensure compliance with 29 CFR 1910.165. (c) Location - 9 Opportunity Way, Newburyport, MA: On or about December 4, 2018, the facility's integrated contingency plan did not include procedures for handling small and/or incidental releases of highly hazardous chemicals including criteria for determining what constitutes a small and/or incidental release compared to an emergency.
