29 CFR 1910.1053(j)(1): The employer did not ensure that each employee has access to labels on containers of crystalline silica and safety data sheets, and were trained in accordance with the provisions of the Hazard Communication Standard (HCS) and paragraphs (j)(3)(i)(A)-(j)(3)(i)(E) of this section: (a) Bay 1, Fill Station; On or about October 30, 2024, employees filling pipes with silica sand (Covia Crystalline Silica Quartz) were not provided with the safety data sheet, and had not received training on the hazards of respirable crystalline silica prior to its use, to include but not be limited to, the health hazards associated exposure; tasks in the workplace that could result in exposure; and measures implemented to protect employees from exposure.
