Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: Employees loading 5/8-inch thick steel sheets onto the plasma table, were using below-the- hook lifting devices that were manufactured at the facility. The lifting devices, an S-hook and a V-hook, were not proof tested, inspected or marked for their rated capacity prior to being put into service. The parts lifted with the devices ranged in weigh from approximately 1,020 pounds to 1,200 pounds. Among other feasible method, one feasible and acceptable method to correct this hazard is to ensure the below-the-hook lifting devices are proof tested, inspected and marked in accordance with ASME B30.20 - 2006 American Society of Mechanical Engineers, Below- the-Hook Lifting Devices, Section 20-1.2.1 Marking, Section 20-1.3.1 Inspection, and Section 20-1.3.8.2 Load Test. ***Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c)***
