29 CFR 1910.1053(f)(1): The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the Permissible Exposure Limit (PEL), unless the employer can demonstrate that such controls are not feasible: (a) Bay 1, Fill Station; On or about October 30, 2024, an employee filling pipes with silica sand (Covia Crystalline Silica Quartz) was exposed to an 8-hour time weighted average (TWA) of 256.51 micrograms/cubic meter (ug/m3) for respirable crystalline silica (RCS), approximately 5.13 times the Permissible Exposure Limit (PEL) of 50 ug/m3. The exposure level was derived from samples collected over a 197-minute sampling period, with zero exposure assumed for the unsampled period of 283 minutes. The engineering and work practice controls were not effective in reducing exposure to or below the PEL.
