29 CFR 1910.1053(f)(2)(i):The employer did not establish and implement a written exposure control plan: a.) On or about November 16, 2023, and at times prior, the employer did not have a written exposure control plan where employees were known to be exposed to respirable crystalline silica. OSHA conducted personal exposure sampling on November 29, 2023 and found three employees exposed to an 8-hour Time-Weighted Average of 349.5 - 373 milligrams per cubic meter of respirable crystalline silica, above the Action Level of 0.025 milligrams per cubic meter (or 25 micrograms per cubic meter).
