29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: a) On or about April 28, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces. Employees were required to enter permit spaces to perform maintenance work on actively moving or energized tensioning systems in the top and bottom housings of chair lifts including, but not limited to, the American Flyer and the American Eagle. These spaces were approximately 3 feet high, 20 feet wide, 40 feet long, located between the work platform and the underside of the lift housings, and contained large fly-wheels and tensioning carriages. Danger signs or other equally effective means which communicated the existence and location of and the danger posed by the permit spaces were not posted. This condition exposed employees to caught-in hazards.
